Welcome to SpainServerHosting. By using or purchasing any of our hosting services (VPS, Dedicated, Cloud, Shared, Domain registration, or other related services), you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use our services.
2. Definitions
- Service: Any hosting, domain registration or related service provided by us.
- Customer / Client / You: The person or entity who purchases or uses our Service.
- Account: The account created by Customer to access the Service.
3. Eligibility & Account Information
- You confirm that you are at least 18 years old and have the legal right to enter into this agreement.
- You must provide accurate, current and complete information (name, contact, billing, etc.) when registering.
- You are responsible for updating your information if it changes.
4. Use of Services — Acceptable Use
- You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations.
- You must not use the Service to host illegal content, infringe intellectual property, distribute malware, spam, or engage in abusive behaviour.
- You are responsible for all content and activities on your account.
5. Payment, Renewal and Billing
- Services are billed according to the plan selected at the time of purchase.
- Renewal is automatic unless cancelled before renewal date.
- If payment fails or account becomes overdue, we reserve the right to suspend or terminate the Service.
6. Service Availability & SLAs
- While we strive for high availability, we provide no absolute guarantee unless specified under SLA.
- Our SLA (see separate SLA document) governs commitments for uptime, support response times, and remedies for failures.
7. Intellectual Property & Content
- You retain ownership of all content you upload to the servers (“Customer Content”).
- We reserve all rights over our infrastructure, software, and any tools used to provide the Service.
- You grant us a license to store and transmit your Customer Content as needed to provide the Service.
8. Liability Limitation
- We are not liable for indirect, incidental, consequential, special or punitive damages (including loss of data, revenue or profit) arising from service downtime, data loss or other issues.
- Our liability shall be limited to a refund or credit of the fees you paid for the affected period — subject to the SLA’s maximum credit cap.
9. Termination
- Either party may terminate the Service as per the plan terms.
- Upon termination, you must remove your data. We may delete your data after a reasonable grace period, unless otherwise agreed.
- We may suspend or terminate services at our discretion if you violate Terms or misuse the Service.
10. Changes to Terms
- We reserve the right to update or modify these Terms at any time.
- We will notify clients via email or account dashboard; continued use of Service implies acceptance of new Terms.
11. Governing Law & Dispute Resolution
- These Terms shall be governed by applicable laws in the country of registration.
- Disputes may be resolved by arbitration or through courts, as per local law (to be specified).
